General Terms and Conditions of Smartlauf Co.

§1 Applicability to Entrepreneurs and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity (§ 13 BGB).

§2 Conclusion of a Contract, Storage of the Contract Text

(1) The following provisions regarding the conclusion of a contract apply to orders placed via our online shop at https://www.smartlauf.com.

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part but is merely a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following rules apply:

The order process includes the following steps:

1. Selection of the desired goods

2. Confirmation by clicking the “Order” button

3. Reviewing the details in the shopping cart

4. Clicking the “Checkout” button

5. Logging into the online shop after registration and entering login details (email address and password)

6. Final review and correction of entered data

7. Binding submission of the order by clicking the “Order with obligation to pay” or “Buy” button

Before submitting the binding order, the consumer can return to the webpage where the customer details were entered and correct input errors using the “Back” button in their web browser or cancel the order process by closing the web browser.

We confirm receipt of the order immediately via an automatically generated email (“Order Confirmation”). With this, we accept your offer.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order details and our Terms and Conditions via email. You can view the Terms and Conditions at any time at https://www.smartlauf.com/agb.

Your past orders can be viewed in our customer area under “My Account –> My Orders.”

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and other price components. Any applicable shipping costs are additional.

(2) The consumer can pay using the following methods:

• Credit card (Visa, Mastercard)

§4 Delivery

(1) Unless otherwise stated in the product description, all items we offer are ready for immediate shipment. Delivery occurs within a maximum of 5 business days.

The delivery period begins the day after the payment order is placed with the transferring bank in case of advance payment or the day after contract conclusion for other payment methods. If the deadline falls on a Saturday, Sunday, or a public holiday at the delivery location, the deadline is extended to the next business day.

(2) The risk of accidental loss or deterioration of the sold goods does not transfer to the buyer until the goods are handed over, even in the case of a shipping purchase.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been received.

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments received from you, including delivery costs (except for additional costs arising from your choice of a different type of delivery than the cheapest standard delivery we offer), without undue delay and at the latest within fourteen days from the day we receive notification of your withdrawal.

For this repayment, we use the same payment method that you used in the original transaction unless expressly agreed otherwise with you. In no case will you be charged fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.
